Welcome to ScaloFly ("we", "our", "us"). By using our website and services (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

ScaloFly provides AI-powered advertising guidance for e-commerce sellers. The Service includes Agent 1, which offers advertising strategy, creative concepts, scripts, creator briefs and feedback on videos you upload, and Agent 2, which analyzes advertising performance data and gives recommendations.

2. Read-only access to ad data

If you connect an advertising account, you give us read-only access to performance data. We do not create, launch, edit, pause, scale or spend on any ad or campaign on your behalf. Every decision to act on a recommendation is made and carried out by you in your own ad account.

3. Recommendations only, no guarantees

Our content and recommendations are guidance based on the data available and general advertising practice. We do not guarantee any result, including click-through rate, conversion rate, return on ad spend, sales or profit. Results depend on many factors outside our control, such as platform algorithms, competition, your product and your own execution. You are responsible for deciding whether to act on any recommendation. Data is analyzed on a schedule and is not real-time.

4. Your responsibilities

You are responsible for following the rules and laws that apply to your ads, including the policies of Meta, TikTok and Google, and any rules on disclosing AI-assisted content, testimonials or endorsements.

5. Acceptable use

You agree not to use the Service to create or promote anything illegal, fraudulent or deceptive; counterfeit goods or products banned by law or by the ad platforms; fake reviews or fake testimonials; or to try to access or interfere with parts of the Service you are not allowed to use. We may suspend or end accounts that break these rules.

6. Subscriptions and billing

Paid plans are billed on a recurring basis through our payment processor, Lemon Squeezy. You can cancel at any time, and your access continues until the end of your current billing period. See our Refund Policy for refunds.

7. Your content

You keep ownership of the product images, data and materials you upload. You give us a limited license to process them only to provide the Service to you.

8. Third-party services

The Service relies on third parties, including AI providers and advertising platforms. We are not responsible for their availability, performance or policies.

9. Limitation of liability

To the fullest extent allowed by law, ScaloFly and its operator are not liable for indirect, incidental, special or consequential damages, including lost profits or advertising spend, arising from your use of the Service.

10. No warranties

The Service is provided "as is" and "as available", without warranties of any kind.

11. Changes

We may change the Service or these Terms. We will give notice of important changes where reasonably possible.

12. Termination

We may suspend or end your access if you break these Terms. You may stop using the Service at any time.

13. Governing law

These Terms are governed by the laws of the country where ScaloFly's operator is based.
